Terms of Use

1. Acceptance of Terms

By downloading, installing, or using the Dino Bilingual application (the “App”), you agree to be bound by these Terms of Use (“Terms”). If you do not agree to these Terms, do not use the App.

These Terms apply in addition to Apple's Licensed Application End User License Agreement (Apple EULA) and Google Play's Terms of Service. In the event of a conflict, Apple's EULA or Google's Terms shall control with respect to their respective platforms.

2. Eligibility

You must be at least 13 years old to use the App (or the applicable minimum age in your country). By using the App, you represent and warrant that you meet this age requirement. If you are under 18, you confirm that your parent or legal guardian has reviewed and agreed to these Terms.

3. License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on any iOS or Android device you own or control, solely for your personal, non-commercial purposes.

You may not:

• Copy, modify, distribute, sell, or lease any part of the App or its content.
• Reverse engineer, decompile, or attempt to extract the source code of the App, except as permitted by applicable law.
• Use the App for any commercial purpose or in any manner not permitted by these Terms.
• Use automated tools, bots, scrapers, or scripts to access or interact with the App or its content.

4. Account Registration

To access certain features, you must create an account using an email address, Google account, or Apple ID. You are responsible for:

• Providing accurate and complete registration information.
• Maintaining the confidentiality of your account credentials.
• All activity that occurs under your account, whether or not authorized by you.

Notify us immediately at support@dinobilingual.com if you suspect unauthorized use of your account.

5. Subscriptions and Payments

5.1 Dino Premium Subscription

The App offers an optional premium subscription (“Dino Premium”) that unlocks additional features. Dino Premium is billed on a monthly, quarterly, or annual basis at the price displayed in the App at the time of purchase.

5.2 Billing

All purchases are processed through the Apple App Store (iOS) or Google Play (Android). Payment is charged to your Apple ID or Google account at confirmation of purchase. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.

5.3 Free Trial

We may offer a free trial period for Dino Premium. Any unused portion of a free trial is forfeited when you purchase a subscription. After the trial, you will be charged the standard subscription price.

5.4 Cancellation and Refunds

You may cancel your subscription at any time through your Apple ID account settings (iOS) or Google Play subscription settings (Android). Cancellation takes effect at the end of the current billing period — you retain access to Dino Premium features until then.

Refunds are governed by the refund policies of the platform through which you purchased. We do not independently issue refunds for App Store or Google Play purchases. To request a refund on iOS, visit reportaproblem.apple.com. On Android, visit Google Play's refund help page.

5.5 Price Changes

We reserve the right to change subscription prices. We will provide reasonable notice of any price changes through the App or via email. Continued use after the price change takes effect constitutes acceptance of the new price.

6. Content

6.1 Article Content

Articles displayed in the App are sourced from third-party publishers. We do not own or control this content. Articles are provided for personal, educational use only. You may not reproduce, republish, or redistribute article content without the original publisher's permission.

6.2 User-Generated Content

You may save words and configure reading preferences within the App. This content is stored on your account and is not shared with other users. You retain ownership of any content you create.

6.3 Translations and Definitions

Word translations, definitions, and example sentences provided in the App are for educational purposes. We make reasonable efforts to ensure accuracy but do not warrant that translations are complete or error-free.

7. Prohibited Conduct

You agree not to:

• Use the App in any way that violates applicable local, national, or international law or regulation.
• Impersonate any person or entity or falsely represent your affiliation with any person or entity.
• Attempt to gain unauthorized access to the App, its servers, or any connected systems.
• Transmit any malicious code, viruses, or other harmful material.
• Interfere with or disrupt the integrity or performance of the App or its data.
• Circumvent any access controls, usage limits, or subscription verification mechanisms.

8. Intellectual Property

The App, including its design, graphics, UI, software, and branding (the “Dino Bilingual” name and logo), is owned by us and protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms transfers any intellectual property rights to you.

9. Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review the Privacy Policy to understand our data practices.

10. Third-Party Services

The App integrates third-party services including Google Firebase and the Apple App Store. Your use of those services is subject to their respective terms and privacy policies. We are not responsible for the practices of third-party services.

Links or references to third-party websites or content within the App are provided for convenience only. We do not endorse and are not responsible for third-party content.

11. Disclaimers

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. Language learning results vary by individual and we make no guarantee regarding your proficiency improvement.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APP.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $10 USD IF YOU HAVE NOT MADE ANY PAYMENTS.

Some jurisdictions do not allow exclusion of implied warranties or limitation of liability, so the above limitations may not apply to you.

13. Indemnification

You agree to indemnify and hold harmless Dino Bilingual and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the App, violation of these Terms, or infringement of any third-party rights.

14. Termination

We reserve the right to suspend or terminate your account and access to the App at any time, with or without notice, for conduct that we reasonably believe violates these Terms or is harmful to other users, us, or third parties.

You may delete your account at any time from the App under Settings → Account → Delete Account. Upon account deletion, your personal data will be handled as described in our Privacy Policy.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of the jurisdiction in which we are established, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the App shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration or the courts of competent jurisdiction, as applicable.

Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent irreparable harm.

16. App Store Requirements

The following terms apply as required by Apple and Google for apps distributed through their platforms:

• Apple: These Terms are between you and Dino Bilingual only, not with Apple Inc. Apple is not responsible for the App or its content. Apple has no obligation to provide maintenance or support for the App. Apple is a third-party beneficiary of these Terms and may enforce them against you.
• Google: These Terms are between you and Dino Bilingual only, not with Google LLC. Google is not responsible for the App or its content.

17. Changes to These Terms

We may modify these Terms at any time. We will notify you of material changes through the App or via email. The updated Terms will be identified by a new effective date. Continued use of the App after the effective date constitutes acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using the App and may delete your account.
